Terms & Conditions

Chocstop Desserts is a trading name of ARMA TRADING LTD, company number 17506504.

1. About us

Chocstop Desserts is a trading name of ARMA TRADING LTD, company number 17506504. Our business address is 98–100 Manchester Road, Nelson, Lancashire, BB9 7HD. Phone: 01282 219809.

In these terms, "we", "us" and "our" mean ARMA TRADING LTD trading as Chocstop Desserts, and "you" means the person placing the order.

2. These terms

These terms apply when you order food and drink from Chocstop Desserts online — on our website or through our ordering pages — or through WhatsApp. Our online ordering and WhatsApp ordering are provided using Whazii, an ordering platform we use; your contract for the food is with us.

Please read these terms before you order. Nothing in them affects your legal rights as a consumer (see section 13).

Our Privacy Policy explains how we use your personal information.

3. Placing an order

  • Choose your items and options, and whether you want collection or delivery (delivery is only available where offered and to the areas shown at checkout).
  • Give us your name and a phone number we can reach you on, and for delivery your full, correct address. You are responsible for making sure these details and your order are correct — we will use them to prepare, deliver and contact you about your order.
  • Tell us about any allergies before you order (see section 8).
  • We may contact you by phone or WhatsApp about your order.

4. When your order is accepted

Your order is accepted, and a contract between us is made, when your payment has been confirmed and we show or send you an order confirmation (on screen and, where available, on WhatsApp).

We may have to decline or cancel an order — for example if an item is unavailable, your address is outside our delivery area, or we cannot fulfil it for reasons outside our control. If we do, we will tell you and refund any payment for the part we cannot provide.

5. Prices, charges and payment

  • Prices are in pounds sterling and are shown on our menu. The price you pay is the one shown at checkout when you place your order.
  • Any delivery charge and any service fee are shown at checkout before you pay.
  • Online orders are paid by card when you place the order. Card payments are processed securely by Stripe; we do not see or store your full card number.
  • If we discover an obvious pricing mistake after you order, we will contact you before going ahead, and you can cancel for a full refund.

6. Collection and delivery

  • Collection and delivery times shown are our best estimate, not a guarantee. Busy periods, traffic and weather can cause delays — we will try to let you know if your order is running late.
  • For collection, please come to our shop and give the name or order number on your order.
  • For delivery, someone needs to be available to receive the order at the address given. If we can't deliver because we can't reach you or the address is wrong, we will try to contact you and will talk to you about what we can do.

7. Menu availability and changes

Items are subject to availability. If something you ordered is not available, we will not swap it for something else without asking you — we will contact you to offer an alternative or refund that item. Photos are for illustration and items may look slightly different.

8. Allergies and dietary needs

If you have a food allergy or intolerance, please contact us before you order so we can tell you about the ingredients and allergens in our food. You can also add allergy information in your order notes, but please call us as well if it is important — notes are not a substitute for speaking to us.

Unless we tell you otherwise, we cannot guarantee that any item is completely free from a particular allergen, because our kitchen prepares many different products.

9. Cancelling, problems and refunds

  • Because our food is made to order and is perishable, the usual 14-day right to cancel online purchases does not apply.
  • If you want to cancel, call us as soon as possible. If we have not started preparing your order, we will cancel it and refund you in full. Once preparation has started we may not be able to cancel it.
  • If something is wrong with your order — for example an item is missing, incorrect or not of the quality you are entitled to expect — please contact us as soon as possible, ideally the same day, with your order details. We will put it right, which may mean replacing the item or giving a full or partial refund, as the law requires.
  • Refunds are made to the card you paid with. Your bank may take a few working days to show the money in your account.

10. WhatsApp messages

  • When you order, we use WhatsApp to send your order confirmation and receipt, updates on your order, and replies to your questions.
  • We only send offers and reminders if you have agreed to receive them. You can reply STOP at any time to stop them; order messages will still be sent for orders you place.
  • WhatsApp is a third-party service provided by WhatsApp (part of Meta) and is subject to its own terms.

11. Third-party services and outages

Our online and WhatsApp ordering rely on services run by other companies, including Whazii (our ordering platform), WhatsApp and Meta, Stripe (payments) and hosting providers. If any of them are unavailable, ordering online or on WhatsApp may not work — you can still call us or visit our shop.

We are not responsible for delays or failures caused by events outside our reasonable control, but if we cannot fulfil an order you have paid for, we will refund you.

12. Our responsibility to you

  • If we fail to keep to these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure or our failure to use reasonable care and skill.
  • We do not exclude or limit our liability where it would be unlawful to do so — including for death or personal injury caused by our negligence, for fraud, or for breaking your legal rights as a consumer.
  • We supply food and drink for personal use only, so we are not responsible for business losses such as loss of profit or business interruption.

13. Your legal rights

Under the Consumer Rights Act 2015, the food and drink we provide must be of satisfactory quality and as described, and our services must be provided with reasonable care and skill. If they are not, you have legal rights to a remedy. Citizens Advice (citizensadvice.org.uk, 0808 223 1133) can give you free information about your rights. Nothing in these terms affects them.

14. Law and disputes

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.

If you have a complaint, please contact us first — we will always try to put things right.

15. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one shown on our website when you place it. This version was last updated on 15 October 2026.
